Return, Refund, Cancellation & Event Policy

 Lucky Dog Coffee

This Policy constitutes a binding agreement between the customer (“Customer”) and Lucky Dog Coffee (“Company,” “we,” “us,” or “our”). By purchasing products or services, Customer agrees to the terms set forth below.


1. Perishable Food & Beverage Sales

All food and beverage products are perishable and prepared to order.

ALL FOOD AND BEVERAGE SALES ARE FINAL. NO REFUNDS. NO RETURNS. NO EXCHANGES.

Customer must inspect orders at time of receipt. Any preparation error must be reported immediately and no later than 12 hours from pickup or confirmed delivery.

If verified by management, the sole and exclusive remedy shall be, at Company’s discretion:

  • Remake of the item the same business day, OR
     
  • Store credit equal to the purchase price
     

Refunds to original payment method are not guaranteed and remain solely at Company discretion.

Failure to notify within required timeframe constitutes waiver of any claim.


2. Merchandise Returns

Returns are accepted only if ALL conditions are met:

  • Request made within 7 calendar days
     
  • Original receipt presented
     
  • Item unused, unworn, unwashed
     
  • Original packaging and tags intact
     

Approved returns will be issued as store credit only.

NO CASH REFUNDS. NO CREDIT CARD REVERSALS except where required by law.

Final Sale Items include but are not limited to:

  • Discounted merchandise
     
  • Seasonal items
     
  • Custom or special orders
     
  • Promotional items
     
  • Used or altered goods
     

Company reserves the right to refuse any return that does not strictly comply.


3. Gift Cards (California Civil Code §1749.5)

In compliance with California law:

  • Gift cards do not expire.
     
  • No dormancy fees are charged.
     
  • Cards are non-refundable.
     
  • Balances under $10 are redeemable for cash upon request.
     

Lost, stolen, altered, or unauthorized cards will not be replaced.


4. Catering & Event Orders

All catering and large-format orders require prepayment or non-refundable deposit.

Cancellation Schedule:

  • 96+ hours prior: 75% refund
     
  • 48–96 hours: 50% refund
     
  • Under 48 hours: Non-refundable
     

Custom or specialty items become non-refundable immediately upon production commencement.

Guest count reductions within 48 hours are non-refundable.

Rescheduling is not guaranteed.


5. Mobile Cart & Off-Site Event Waiver

For all mobile, pop-up, school, private, corporate, or off-site events:

Customer acknowledges and agrees:

  • Venue conditions are outside Company control.
     
  • Power supply, surface stability, weather, and access are Customer responsibility unless otherwise contracted.
     
  • Customer assumes responsibility for ensuring safe placement and operation space.
     

ASSUMPTION OF RISK
Customer understands that mobile food and beverage service involves hot liquids, electrical equipment, generators, and heavy equipment. Customer voluntarily assumes all risks associated with event environment conditions not directly caused by Company’s gross negligence.

WAIVER & RELEASE
Customer releases, waives, and discharges Lucky Dog Coffee, its owners, employees, contractors, and agents from any claims, liabilities, damages, or losses arising out of:

  • Venue-related hazards
     
  • Third-party conduct
     
  • Weather conditions
     
  • Power failures
     
  • Guest negligence
     
  • Property damage not directly caused by Company gross negligence
     

INDEMNIFICATION
Customer agrees to indemnify and hold harmless Lucky Dog Coffee from any claims, demands, damages, attorney’s fees, or liabilities arising from event conditions, venue defects, or guest conduct.


6. Third-Party Delivery Orders

All issues must be addressed through the third-party platform first.

Company is not liable for:

  • Delivery delays
     
  • Driver handling
     
  • Platform system failures
     
  • Platform service fees
     

Duplicate refunds will not be issued.


7. Chargebacks & Fraud

Initiating a chargeback without first attempting resolution directly with Company constitutes breach of this agreement.

Company maintains transaction records, timestamps, fulfillment logs, and security documentation to dispute illegitimate claims.

Fraudulent or abusive chargebacks may result in:

  • Permanent service refusal
     
  • Online ordering revocation
     
  • Cash-only transaction restriction
     
  • Collection action for disputed funds and fees
     

Company reserves all rights to pursue civil remedies.


8. Limitation of Liability

To the fullest extent permitted by California law:

Company shall not be liable for indirect, incidental, consequential, special, or punitive damages.

Company’s maximum liability shall not exceed the total amount paid for the product or service giving rise to the claim.

Nothing in this policy limits liability for gross negligence or willful misconduct where prohibited by law.


9. Force Majeure

Company shall not be liable for failure to perform due to causes beyond reasonable control, including but not limited to:

  • Acts of God
     
  • Weather events
     
  • Government restrictions
     
  • Power outages
     
  • Supply chain disruptions
     
  • Labor shortages
     

In such cases, remedies may include rescheduling or store credit at Company discretion.


10. Right to Refuse Service

Company reserves the right to refuse service to any individual for lawful reasons, including policy abuse, threatening behavior, or fraudulent activity.


11. Arbitration & Venue

Any dispute arising under this Policy shall be resolved by binding arbitration in Ventura County, California, in accordance with California law.

Customer waives the right to participate in class action claims.

If arbitration provision is found unenforceable, exclusive venue shall be Ventura County, California.


12. Policy Disclosure

This policy is posted in compliance with California Civil Code §1723.

Completion of purchase constitutes acceptance of these terms.

Company reserves the right to modify this Policy at any time without prior notice.
